Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ProfessionalOS app and related services (the “Service”), provided by ProfessionalOS (“ProfessionalOS”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. By using ProfessionalOS, you confirm that you meet these requirements and that the information you provide is accurate.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us promptly at contact@professionalos.ai if you suspect any unauthorised use.

3. The Service

ProfessionalOS provides daily self-development content, assessments, tools, and AI-assisted coaching designed to help you grow as a professional. We may add, change, or remove features over time to improve the Service.

It is not professional, legal, financial, medical, or psychological advice, and it is not a substitute for advice from a qualified professional. AI-generated responses may be inaccurate or incomplete — please use your own judgement and seek appropriate professional advice before making significant decisions.

You retain ownership of the content you create in the Service (such as journal entries and notes). You grant us a limited licence to store, process, and display that content solely to operate and improve the Service for you. We do not claim ownership of your personal content.

8. Intellectual property

The Service, including its software, design, branding, and content we provide, is owned by ProfessionalOS and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use in accordance with these Terms.

You acknowledge that these Terms are between you and ProfessionalOS only, and not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. To the extent the app is acquired through the App Store, you must comply with the Apple Media Services Terms and the standard Apple Licensed Application End User Licence Agreement (EULA), which apply in addition to these Terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that results obtained from using it will meet your expectations.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you may have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.

12. Limitation of liability

To the extent permitted by law, ProfessionalOS will not be liable for any indirect, incidental, special, or consequential loss, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim relating to the Service is limited, to the extent permitted by law, to the amount you paid us for the Service in the 12 months before the claim.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.

14. Governing law

These Terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of the courts of Australia in connection with any dispute relating to the Service.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you within the app. Your continued use of the Service after an update means you accept the revised Terms.
